Conflict Resolution
When it comes to sourcing from China and possible conflicts, frequently the issue is one of quality, then payment, then logistics, and finally IP.
With respect to quality concerns, the question is how to deal with the situation when what you get from a China supplier is not what you expected. The related question is, “How do we fix it, who will pay for the additional labor, shipping, duties and taxes, and how soon can I receive so I don’t need to disrupt my operations?”.
In the case of payments, Myland USA is often called upon to set up logical, favorable payment terms for its clients. Even when both parties follow through with the accepted, negotiated payment terms, problems may still crop up. IP can also be a source of conflict. An example is IP that is registered in the U.S. but not in China. A Chinese factory is free to produce the product protected by the U.S. IP for sale to any market other than the U.S. since the IP was never registered in China. However if a U.S. importer were to try to import and distribute such products on U.S. soil, the original U.S. IP holder would have legal rights against the importer.
